Terms of Service

1.1 Overview of Services

Pomelo Side Hustles LLC ("Pomelo") provides resale-related services including, but not limited to, inventory assessment, market-based pricing guidance, listing support, buyer coordination, logistics coordination, and operational assistance. Pomelo does not act as a licensed appraiser, auctioneer, or guarantor of sale outcomes.

1.2 No Guarantee of Sale or Price

All pricing recommendations are advisory estimates based on observable market data, historical resale experience, and current conditions at the time of evaluation. Pomelo does not guarantee that an item will sell, sell within a specific timeframe, or achieve a particular price. Market demand, buyer behavior, and third-party platform policies may change at any time.

1.3 Ownership of Items

Clients retain ownership of all items at all times until a sale is completed and buyer payment is confirmed, unless otherwise agreed to in writing. As the owner, the client is responsible for maintaining items in substantially the same condition as represented at intake, listing, or marketing. Clients agree to promptly disclose any material changes in condition, damage, loss of parts, or functionality that occur prior to sale or exchange. Pomelo is not responsible for changes in value, buyer dissatisfaction, or failed transactions resulting from undisclosed or altered item conditions. Pomelo’s role is limited to resale coordination and support services. Responsibility for items remains with the owner except where Pomelo has explicitly agreed in writing to provide storage, transport, or other custodial services.

1.4 Third-Party Platforms and Participants

Pomelo may list, promote, or coordinate sales through third-party platforms and services. Pomelo is not responsible for the actions, communications, conduct, delays, policy changes, or enforcement decisions of buyers, sellers, payment providers, marketplaces, or logistics partners.

1.5 Fees, Earned Services, and Payments

Fees, commissions, or service charges are disclosed prior to engagement. Fees for services such as pricing evaluations, listing creation, marketing, or coordination are considered earned upon completion of the applicable service and are non-refundable.

1.6 Content Usage and Protection (Photos, Videos, Marketing Materials)

By engaging Pomelo and providing access to items, clients grant Pomelo a non-exclusive, royalty-free, worldwide license to photograph, video record, and otherwise capture images or media of items for purposes including resale listings, marketing, promotion, education, and business development. All photographs, videos, written descriptions, pricing logic, marketing assets, and derivative works created by Pomelo remain the intellectual property of Pomelo Side Hustles LLC unless otherwise agreed in writing. Clients and third parties may not reuse, reproduce, distribute, or commercially exploit Pomelo-created content without prior written consent. Pomelo may also use anonymized or non-identifying content for portfolio examples, case studies, social media, educational materials, or promotional use.

1.7 No Reliance on Advice

Clients acknowledge that resale outcomes depend on factors beyond Pomelo’s control and agree not to rely on pricing guidance, recommendations, or market commentary as a guarantee of results.

1.8 Limitation of Liability

Pomelo is committed to providing thoughtful, professional resale support. That said, resale outcomes depend on many factors outside Pomelo’s control. To keep expectations fair and proportional, Pomelo shall not be liable for indirect, incidental, consequential, or speculative damages, including loss of anticipated profit or market opportunity. Pomelo’s total liability for any claim related to the services shall not exceed the fees paid for the applicable service.

1.9 Dispute Resolution

Pomelo believes most issues can be resolved through open and good-faith communication. If a concern arises, clients agree to first contact Pomelo to seek an informal resolution. If a matter cannot be resolved informally, the parties agree to attempt non-binding mediation before pursuing formal legal action. This approach is intended to minimize cost, time, and stress for everyone involved. Any dispute that proceeds beyond mediation shall be governed by the laws of the State of Washington, and brought in the state or federal courts located within Washington.

1.10 Right to Modify Services

Pomelo reserves the right to modify, update, or discontinue services, pricing structures, tools, methodologies, and operational practices at any time.

1.10 Termination

Either party may terminate services at any time subject to completion of active obligations and payment of earned fees.
